•  POST JUDGMENT MODIFICATION  •

 
Parties often have obligations to each other, even after a final order for dissolution or support is entered. This is especially true when children or support is involved due to changes in circumstances with the children and the parties. When a change arises and one or both of the parties wish to modify an existing order, a modification order must be entered in the case. Modifications can relate to child custody and vistiation as well as child and spousal support.
 
A modification can only occur on those matters over which the court continues to have jursidiction. Modifications require the court to examine the current order and compare it to the facts surrounding the requested change.
 
These changes can include:
  • Changes in a party’s need or ability to pay, such as the need to reduce child support payments because of job or income loss or reduction that prevents a person from making payments or an increase in income to the non-custodial parent.
  • Increased financial needs of the child.
  • Behavior or substance abuse problems in the custodial parent's home that adversely impact the child.
  • Relocation needs of one of the parents.
